Ownership and authority to sell
The person posting the listing declares that they own the equipment or are expressly authorised to offer it for sale on behalf of its owner, and that they will not conceal circumstances affecting the sale, such as seizure, pledge, leasing or third-party rights.
Company identity and authorised users
A single verified company workspace is used for each tax number and trade name. A second account may not be opened on behalf of the same company to obtain a new free entitlement. Additional users join the existing company through an invitation and role assigned by the company administrator under a Gold or higher corporate membership; these users’ listing transactions are recorded in the audit trail under both the user and the company. The company administrator is responsible for keeping invitations and authorisations current.
Accuracy of information and product defects
The brand, model, year of manufacture, operating condition, capacity, defects known or discoverable by reasonable inspection, maintenance and revision history, explanation concerning serial information, and invoice and warranty status must be disclosed accurately, currently and completely. Civil, administrative and criminal liability for undisclosed defects, missing parts, non-conformity, safety risks, ownership or authority issues, and incorrect or incomplete statements rests with the user posting the listing and the company on whose behalf they act. The buyer’s rights under mandatory legislation remain reserved.
Images of the actual product and intellectual property rights
Every uploaded image must be an original, current and non-misleading photograph of the actual equipment offered for sale, allowing the product to be identified. Images of another product, stock/catalogue images, images concealing defects, incorrectly matched images or images for which usage rights are not held may not be uploaded. Responsibility for the selection, accuracy and lawfulness of images and third-party rights rests with the user posting the listing and the company.
Notice of unlawfulness and removal
Allegations of unlawful content, counterfeit products or infringement of personality or intellectual property rights may be reported through the support channel, specifying the listing, ownership of the rights and the alleged infringement. The platform may record the notice and suspend the content during review, and carries out the removal, access blocking, evidence preservation and notification to the competent authority required by legislation. This process does not remove the listing owner’s legal liability.
Quotes, payment and delivery
A message or quote within the platform does not in itself constitute a sales contract, payment guarantee or assurance of reservation. The parties separately agree in writing on inspection, expert assessment, contract, payment, dismantling, loading, transport, insurance and delivery terms.
Listing fee and company quota
The first approved listing per verified company/tax identity is free for 30 days. Additional users within the same company do not receive a new free entitlement. Every listing publication after the first entitlement and each renewal costs 25 USD / 30 days; the sales commission is 0%. Payment is not a guarantee of the accuracy of the listing or seller.
Role of the platform and limitation of liability
Ekipmanda is an electronic commerce intermediary providing listing publication, communication and moderation infrastructure; it is not the seller, buyer, product owner, expert inspector, carrier or payment guarantor. Moderation, company verification, collection of fees or publication of a listing does not constitute a guarantee of the product’s authenticity, ownership, images, operating condition, safety, freedom from defects or delivery. Liability arising from the listing content and the product offered for sale rests with the user posting the listing and the company. The person posting the listing compensates the platform for its direct and documentable loss arising from third-party claims in proportion to that person’s fault and violation. No provision excludes Fabay Teknoloji Limited Şirketi’s liability for intent or gross fault, harm to life or physical integrity, or its obligations arising from mandatory legislation and liabilities that cannot be excluded by contract.
Governing law and jurisdiction
The law of the Republic of Türkiye applies. The Central Courts and Enforcement Offices of Konya have jurisdiction only in disputes between merchants or public legal entities where the conditions in Articles 17 and 18 of the Code of Civil Procedure No. 6100 are met. This provision does not apply to consumer transactions or cases of exclusive jurisdiction; mandatory rules on applications and jurisdiction, including the consumer arbitration committee and consumer court at the consumer’s place of residence or where the consumer transaction took place, remain reserved.
