Ekipmanda and ekipmanda.com are the brand and digital service names operated by Fabay Teknoloji Limited Şirketi; they have no separate legal personality. Fabay Teknoloji Limited Şirketi is the provider of the contracts and digital services within the platform. The member declares that they act on their own behalf or on behalf of a business they are expressly authorised to represent, and that the account, invoice and representation details are correct. This agreement governs fixed-term access to the digital services of the selected Ekipmanda plan.
Membership period
The agreement is monthly and renews at the same billing interval until cancelled. A price or plan change does not automatically apply to an existing membership; separate notice and consent are required.
Plan entitlements
Product, image, communication, team, service, video and Project Room limits are enforced on the server. These entitlements may be suspended in the event of membership cancellation, payment failure or a security review.
Quotas, downgrades and data
New operations exceeding the plan quota may be blocked. A plan downgrade or expiry does not automatically delete existing company, product, quote and operational data; access and rights to new operations are restricted according to the current plan. Data retention or deletion requests are handled separately in accordance with KVKK texts and statutory retention obligations.
Payment security
Ekipmanda does not store the card number, expiry date or CVC; payment is processed in the iyzico form. Ekipmanda records only subscription, price, coupon, provider reference and transaction status information.
Cancellation and payment failure
The authorised membership holder submits a cancellation request with explicit confirmation in their profile. When the provider confirms cancellation, automatic renewal stops and plan access closes at the time explained in the product behaviour. If the network or provider outcome is uncertain, the transaction is not considered final and is placed under review. Payment failure does not delete data but may restrict paid features.
User obligations
The member safeguards access permissions, does not allow unauthorised persons to use them, does not upload unlawful content and keeps company users’ permissions up to date. The member must have the necessary authorisation and have provided the necessary information regarding member content, personal data and third-party rights.
User status
Whether the member is a merchant, tradesperson, public legal entity or consumer is determined by the purpose of the transaction and mandatory legislation, not by a unilateral selection on the registration screen. Opening a corporate account does not automatically turn a transaction to which consumer legislation may apply into a commercial transaction.
Content, third-party claims and compensation
The member is responsible for ensuring that the products, listings, images, documents and statements they upload are accurate, up to date and lawful, and that they hold the necessary ownership, licensing, representation and personal data processing authorisations. For third-party claims arising from a breach of these obligations, the member compensates Fabay Teknoloji Limited Şirketi for its direct and documentable losses in proportion to the member’s fault and breach. No provision removes the obligations or liabilities of Fabay Teknoloji Limited Şirketi arising from its wilful misconduct or gross negligence, harm to life or bodily integrity, or mandatory legislation, or any liabilities that cannot be excluded by contract.
Service continuity and changes
The service may be temporarily restricted due to planned maintenance, a security incident or force majeure. A material reduction of features or a change to price or the agreement is notified to the member before taking effect; previous acceptance records are not altered. Mandatory consumer rights remain reserved.
Limitation of liability
The platform is not a party to contracts for physical products or services between users; it does not guarantee user statements, products, delivery or payment collection. The platform’s liability is limited to losses involving its fault and a direct causal connection; claims for indirect losses and lost profits are excluded to the extent permitted by mandatory law. No provision removes the obligations or liabilities of Fabay Teknoloji Limited Şirketi arising from its wilful misconduct or gross negligence, harm to life or bodily integrity, or mandatory legislation, or any liabilities that cannot be excluded by contract.
Disputes and legislation
The law of the Republic of Türkiye applies. The Central Courts and Enforcement Offices of Konya have jurisdiction only over disputes between merchants or public legal entities where the conditions in Articles 17 and 18 of the Code of Civil Procedure No. 6100 are met. This clause does not apply to consumer transactions or cases of exclusive jurisdiction; mandatory rules on applications and jurisdiction remain reserved, including the consumer arbitration committee and consumer court at the consumer’s place of residence or the place where the consumer transaction took place.
